10 Critical Points About Mold in NYS:

  1.  Article 32 of New York State Labor Law governs all aspects of mold, mold testing and mold abatement.
  2. This mold law, unique to NYS, started in 2016 and was a direct result of improper mold abatement post “Super Storm Sandy” of 2012.
  3. Article 32 requires licensed mold professionals be involved if the interior area of concern is 10 square feet or larger in size.
  4. There are provisions for home and building owners to handle their own mold situations without hiring licensed professionals.
  5. This NYS Mold Law has designated separate licensed categories and requires separate companies for the proper identification and removal of mold.  No one company is permitted to perform all the necessary tasks for proper mold abatement in NYS.
  6. The New York State Licensed Mold Assessor is the designated person who has the responsibility of determining if there is a mold concern or not, what specific protocols will be used for any particular mold project, performs any needed mold testing before, during and/or after abatement when necessary, determines why the mold occurred, what steps should be taken to correct the cause of the mold, what steps should be taken to prevent mold regrowth and finally furnishes mold clearance documentation post abatement when needed.
  7. Mold testing is not required to determine if a mold concern exists.  A NYS Licensed Mold Assessor can identify a mold concern visually without laboratory testing.
  8. There are no established standards in Article 32 for allowable mold spores or allowable mold types in indoor air space.  There should be no visible mold and no odor of mold within the structural envelop of any home or building.
  9. The New York State Licensed Mold Remediation Contractor has a separate license and follows the direction of the NYS Licensed Mold Assessor who developed the abatement protocol for that specific mold project.  All Mold Abatement Workers within any containment work area are also required to be individually and separately licensed.  Mold Remediation Contractors cannot provide their own clearance post any abatement project.   This is the responsibility of the separate and independently Licensed Mold Assessor.
  10. Mold Assessors, Mold Contractors, and Mold Workers in NYS are required to have special training, be individually licensed, receive required/approved updated training every (2) years and carry special insurance.  These requirements all factor into the cost of any mold project
